The Grande Grammaire du Français
(hereinafter “the GGF”)

Effective version from December 23, 2021

 

The Éditions Actes Sud (hereinafter “the Publisher”), public limited company with a board of directors, with a share capital of €5,614,760.00, registered 340 883 974 with the RCS Tarascon, whose office is located at 47, rue du Docteur-Fanton, 13200 Arles Cedex, publishes works, as well as literary services and products for private individuals and professionals.

 

Welcome to the General Terms and Conditions applicable to the GGF (hereinafter referred to as the “Terms and Conditions”) whose two websites www.grandegrammairedufrançais.com and www.abonnements.grandegrammairedufrançais.com are hereinafter jointly referred to as the “Website”.
Please read them carefully before using the Website. By accessing any part of the Website, you agree to be bound by the following Terms and Conditions. If you do not agree to all of the Terms and Conditions of this agreement, then you should not access the Website or use the services offered therein.

The benefit of the services is reserved for persons who have full legal capacity to commit themselves or who can provide, if necessary, a written and valid authorisation from their legal representative.

 

DEFINITIONS

Subscription: subscribing to an online service providing access to products and services, access to which is conditioned by the Publisher’s offers. You will find all of the Publisher’s offers in the Appendix to these Terms and Conditions.

Access to content: the access is granted via account creation, and then online payment for anyone wishing to subscribe.

Customer: the consumer/buyer, otherwise described as any natural or legal person who subscribes to the products and services of the Publisher and has access to the content and features of the GGF.

Order: the order consists of the subscription; it precedes the payment in the case of a fee-based offer.

Publisher: the Éditions Actes Sud (see Legal Statement).

The Grande Grammaire du Français: the French language book published by Éditions Actes Sud exists in paper and digital versions. Its online edition is available in whole or in part, to users and/or customers, by subscription from the Website.

Browsing: you can access the Website free of charge if you know the URL or if another site (a search engine, for example) has redirected you to it. Some pages are only accessible after the creation of an account and payment of a subscription in the case of a fee-based offer. For security reasons, the Publisher may subject your access to the Website to a prior test (“captcha”).

User: any natural person who browses the Website without subscribing to the Publisher’s products and services.

Personal Data Protection Policy: it can be accessed by clicking here.

Products/Services: all or part of the content and services of the online edition of the Grande Grammaire du Français made available by the Publisher to the customer and/or the user including, in particular, the following features: simple and advanced searches, note-taking, memorisation of bookmarks, access to the browsing history, copy and pasting, downloading extracts.

 

ARTICLE 1 – Scope of Application

These Terms and Conditions govern the sales, by the Publisher, of products and services offered by the Publisher on the Website.

As the Terms and Conditions may be subject to change, users are invited to consult them regularly, with the date of the most recent update appearing on the first page, as at present.

Unless expressly agreed otherwise, all customer orders are subject to these Terms and Conditions, notwithstanding any clause to the contrary that may appear on the buyer’s documents and in compliance with the current regulation.

 

ARTICLE 2 – Rules of Use of the Website

Account creation

The creation of an account is done via the Website www.grandegrammairedufrançais.com, from the Subscription space of the home page and then on www.abonnements.grandegrammairedufrançais.com. Your access codes are exclusively personal and are under your responsibility.

Disconnection

In order to properly protect access to his subscription, the User must disconnect front the Site www.grandegrammairedufrançais.com AND www.abonnements.grandegrammairedufrançais.com after using it.
The Publisher cannot be held responsible for any damage resulting from the User's failure to disconnect.

Deactivation of an account

The customer (private individual or professional) may request the deactivation of his account at the following address: dpo@actes-sud.fr, as well as the deletion of his personal data by contacting the DPO at the following address: dpo@actes-sud.fr (mentioning in the subject line: Request concerning my personal data).

Access to the service

The service can be accessed via the page www.grandegrammairedufrançais.com. Once you have created an account, you can decide which offer you want to subscribe to. After payment and subscription to the offer, you can access and use the services during the defined offer period.

Customer Services

As a user, you may contact the customer service department of the Publisher, under the conditions defined in Article 5.

 

ARTICLE 3 – Order Terms

3-1 Order Placement

For private individuals, the order is made online by entering the requested data on the Website.
To place an order, you must have a functional electronic mailbox, as well as an account giving you access to the GGF via identification with your personal codes.
The Publisher confirms your account creation by sending an electronic receipt to the email address you provided.
Once your account has been created, you can edit your personal information in My Account.

For institutions and companies, a quote request is made online. Our customer service will then contact you to define with you the offer best suited to your needs and will send you an order form. After validation of this order form, the order will be placed by our customer service.

3-2 Offer Acceptance and Order Confirmation

If you are a private individual, the acceptance and order confirmation are carried out by a series of data entries on successive screen pages.
Any validation of the order is conditioned by the reading and acceptance of the present Terms and Conditions, thus formulated: “I have read the Terms and Conditions and I fully endorse them.”
The validation of your basket allows you to access the order summary. You can change the items and their quantities.
Once payment has been made, the Publisher confirms your order by sending an electronic receipt to the email address given at the time of your registration.
The contract of sale is formed between the Publisher and you upon receipt of your payment.
If you wish to download your invoice, go to your My subscription space.

If you are an institution, an order form will be sent to you upon receipt of your quote request.
Any validation of the order is conditioned by the reading and acceptance of the present Terms and Conditions, thus formulated: “I have read the Terms and Conditions and I fully endorse them.” You also undertake to make these Terms and Conditions known to the users who will have access to the GGF.
An email from our customer service department then confirms your order. The contract of sale is formed between the Publisher and you upon the issuance of this email.
You have previously provided the Publisher with one or more IP addresses to enable your users to access the Website.

You are informed that the Publisher may, as part of the validation of your Order, ask you about the IP addresses transmitted, and decide, if necessary, to modulate the number of IP addresses transmitted, in order to guarantee the quality of access and availability of our Products and Services.



If you are a company, an order form will be sent to you upon receipt of your quote request.
Any validation of the order is conditioned by the reading and acceptance of the present Terms and Conditions, thus formulated: “I have read the Terms and Conditions and I fully endorse them.” You also undertake to make these Terms and Conditions known to the employees who will have access to the GGF.
An email from our customer service department then confirms your order. The contract of sale is formed between the Publisher and you when this confirmation is issued.
With this confirmation come vouchers to be redistributed to your employees. Each one of them can then create its account so as to access the content of the GGF.

3-3 Lead time for dispatch or provision of services

As the products are dematerialised, they are always in stock and available immediately by logging into your customer account from www.grandegrammairedufrançais.com.

For French institutions, the accesses are given upon receipt of order form.

For non-French institutions, the accesses are given upon receipt of the payment.
For French and non-French companies, the accesses are given upon receipt of payment.

 

ARTICLE 4 – Payment Terms

4-1 Price

The price of the subscriptions offered on the Website and of the promotional offers are indicated in euros (€) all taxes included and are understood to be the unit price.
All orders, regardless of their country of origin, are payable in Euros.
The Publisher reserves the right to change its prices at any time, in accordance with the current regulation. The services are invoiced on the basis of the rates in force at the time the order is placed.
The Publisher is free to offer discounts.

4-2 Secure Payment on order

The direct debit is not implemented by the Publisher but by one of its secure payment providers, which alone retains your payment details. The Publisher does not retain any bank details.

For private indiduals, payments can be made:

  • by credit card: secure transaction with Stripe and the 3D Secure system;
  • by Paypal account: secure transaction with the Paypal secure system.

For professionals, payments can be made by credit card.

In any event, the online provision of your payment card number and the final validation of your order with the 3D Secure system are, in accordance with the law of 13 March 2000 on electronic signatures, proof of the completeness of the order and of the payability of the sums due in execution of said order.

4-3 Institutions payment

For French institutions customers who have opened subscription access accounts, payment is made within 30 days end of the month via the Chorus portal. Payment may also be made by credit card in accordance with the terms and conditions described in 4.2 of these GTC.


In the event of late payment: unless a deferral is requested in good time and granted by the Publisher, failure to pay for the Publisher’s supplies on the due date will result in:
       
in the event of late payment: a fixed indemnity of 40€ for collection costs payable by the debtor to the creditor, pursuant to Articles L441-3, L 441-6 and D 441-5 of the Commercial Law;
       
in the event of non-compliance with the above-mentioned deadline: annual interest on arrears applicable at the ECB rate plus 10 points;
       
possibility for the Publisher to suspend all connection to the customer until the payment is actually received.

For non-French institutions customers, payment will be made upon receipt of the invoice and made by credit card according to the terms and conditions described in 4.2 of these GTC.

 

ARTICLE 5 – Customer Services

The FAQ (Frequently Asked Questions) offers you plenty of information.

On the page of each offer, a "Questions" tab allows you to ask questions about the offer. The customer service department receives the questions and is responsible for answering them. The Publisher reserves the right to display or not the questions and answers. 


However, in the absence of an answer to your questions, our customer service department is at your disposal for any questions. In order to provide you with the most efficient possible response, your name and postal address, or even your customer number, will be useful in tracking your order.

Incoming calls are answered from 9am to 6pm Monday to Friday French time (excluding French public holidays).

ARTICLE 6 – Duration, termination and modification

6-1 The starting date of the subscriptions is the one indicated in the invoice that you receive after payment. For French Institutions, the subscription start date corresponds to the date on which we communicate your access.


Subscriptions are concluded for a firm annual period of twelve (12) months (excluding the discovery offer and voucher offer).
With a flat rate, they are offered for a definite period of time. As they cannot be terminated during its course, they are not refundable.
Your subscription is not automatically renewed. Once your subscription has expired, any renewal is subject to your express agreement. An email from the Publisher then offers you to resubscribe.

6-2 Without entitlement to reimbursement, the Publisher reserves the right to modify all or part of the content of the products, during the course of the subscription.
The Publisher reserves the right to suspend access to the services and/or products.

6-3 The Publisher reserves the right to terminate any subscription without notice and by any means in the event of non-compliance with the Terms and Conditions not rectified after two email notifications. In such cases, the termination is effective upon receipt of the notice of termination and does not give rise to a right to reimbursement.

 

ARTICLE 7 – Right of Withdrawal

You are reminded that, in accordance with Articles L. 221-21 et seq. of the French Consumer Code, the right of withdrawal cannot be exercised for the supply of digital content not supplied on a physical medium, the execution of which has begun after express prior agreement, materialised by your payment for the services as indicated in Articles 3 and 4.
In the present case, any subscription to online services or ordering of products from the GGF in digital format entails the provision of digital content not provided on physical media. Consequently, as a customer/user who has expressly agreed to benefit from the online services or products in digital format, you expressly waive the right to exercise said right of withdrawal.

 

ARTICLE 8 – Guarantees

In accordance with the current regulation for products, you benefit from the legal guarantee of conformity (article L. 217-1 et seq. of the Consumer Code) and the guarantee against hidden defects provided for in articles 1641 to 1649 of the Civil Code.

You are reminded that you are solely responsible for your use of the services and the choice to subscribe.

 

ARTICLE 9 Responsibility

The Publisher uses its best efforts to provide quality content and services. It is not subject to an obligation of result.
The Publisher shall not be liable for any consequential damages, including loss of business, loss of profit.
The editorial content and other data on the Website are not contractual and are presented for information purposes only. They are subject to error, omission and obsolescence. They should not be considered in any way as advice or decision-making assistance. As a user and/or customer, you therefore acknowledge that you interpret and/or use these contents and data at your own risk. As a result, the Publisher cannot be held responsible in case of an error in any of these texts.

You are reminded that the use of the services requires an Internet connection, and that the quality of the services therefore depends directly on the quality of said connection, for which you alone are responsible. The Publisher shall not be held liable in the event of force majeure or failure of the means of communication or telecommunication. You can consult the list of browsers strongly recommended for the use of the GGF as well as the terms of access in the FAQ.

Hypertext links on the Website may lead to other websites. The Publisher disclaims all responsibility in the event that the content of these websites contravenes the current legal and regulatory provisions.

The Publisher’s liability is limited to direct and proven damage suffered by you from us.

In any case where we are found to be liable, and in absence of rectification within a reasonable period of one week from your notification of the event, it is expressly agreed that (except in the case of gross negligence or wilful misconduct duly proved by you) the Publisher’s liability under these Terms and Conditions shall never exceed the annual subscription fee paid by the Customer.

Users and or customers of the Website are encouraged to send to the GGF their remarks on possible malfunctions of the Website at the following address: contact@grandegrammairedufrançais.com

 

ARTICLE 10 – Intellectual Property

In accordance with the terms of article L.335-2 of the Intellectual Property Code, the violation of one of the copyrights of the work is a counterfeiting offence punishable by three (3) years imprisonment and a fine of 300,000.00 euros.
The GGF is a trademark registered with the INPI by the company ACTES SUD.
Any other trademark present on the Website of the GGF is the property of the company ACTES SUD.
All texts, images, sounds and illustrations contained on the Website of the GGF are the exclusive property of the Publisher.

The use or purchase of a product and/or service by a user and/or customer shall not confer upon the latter or any other person a right to the above-mentioned protected elements other than that of strictly personal, non-collective and non-commercial use.

 

ARTICLE 11 - APPLICABLE LAW - MEDIATION - DISPUTES

The present Terms and Conditions are governed by French law. The language of these Terms and Conditions is French while there is also an English language version.
In the event of a dispute, only the French courts have jurisdiction, before the court of the City of Paris.

APPENDIX - SUMMARY OF THE TERMS AND CONDITIONS AVAILABLE TO ONLINE SERVICES

 

PRIVATE INDIVIDUALS SUBSCRIPTIONS

YEARLY SUBSCRIPTION

Subscription to the online edition of the Grande Grammaire du Français gives the private individual access, for a fee, to the entire content of the book as well as to its features (simple and advanced search, note-taking, bookmark memorisation, access to the browsing history, copy and pasting, downloading of extracts) in an unlimited manner for the duration of said subscription.
Price: 39 € per year
Initial subscription period: 365 days
Subscription renewal: subscription renewal can be done at any time in the My subscription space. If the date of renewal precedes the expiry date of the previous subscription, the balance of days is added to the 365 days of the new subscription.

DISCOVERY OFFER

When creating an account on the online edition of the Grande Grammaire du Français, the user, if a private individual, can benefit from a discovery offer. The offer includes access to the full content of the online edition and some features, excluding note-taking, copy-pasting and downloading of extracts. The Publisher reserves the right to withdraw this offer at any time.
Price: Free
Initial subscription period: 15 days
Renewal of the subscription: Access to the “Discovery” offer is not renewable. If you combine the discovery offer with the 1-year subscription, the remaining days of the discovery offer are added to the 1-year subscription in full use.

VOUCHER OFFER 60 days

When purchasing a printed copy of the Grande Grammaire du Français, the private individual finds a “voucher” inside the book. In the form of a sequence of characters, it gives free access for 60 days to the content of the online edition and to all the features. Beyond these 60 days, the user must subscribe to continue using the service.
Vouchers may also be distributed by the Publisher for discovery or promotional purposes.

Initial subscription period: 60 days
Renewal of the subscription: each voucher can only be used once.

VOUCHER OFFER 365 days

The Publisher may may distribute 365 days of the GGF to a partner for information or promotional purposes. The Publisher will send a “coupon” to the partner. In the form of a sequence of characters, it gives free access for 365 days to the content of the online edition and to all the features. Beyond these 365 days, the user may, if he wishes, subscribe to continue using the service
Price: Free
Initial subscription period: 365 days
Renewal of the subscription: each voucher can only be used once.

INSTITUTION OFFER

Institutions can take out a subscription by filling out a quote request on the Website. The subscription includes access to the full content of the online edition of the GGF and to the “search” feature. The other features are not proposed for this type of subscription because the use is in fact shared between several users. Access is limited to the institution’s IP address(es).
Price: the sliding scale of prices is established by the Publisher according to the number of simultaneous connections ordered by the institution.
Initial subscription period: 365 days
Renewal of the subscription: Renewal can be done by contacting the Publisher at: serviceclients@grandegrammairedufrançais.com.

BUSINESS OFFER

Companies can take out one or more subscriptions for one or more of their employees by filling out a quote request on the Website. Subscription include access to the full content of the GGF online edition and all of its features. The Publisher provides the company with individual accesses in the form of vouchers.
Price: the sliding scale of prices is established by the Publisher according to the number of subscriptions ordered by the company.
